These Terms & Conditions (the "Terms") form a legally binding agreement between you ("you", "user", "customer") and Best Switching Games Ltd. ("we", "us", "our", "Best Switching Games"), operator of the website https://www.bestswitchinggames.com (the "Site"). By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms together with our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree, please do not use the Site.

"Account" means the personal user account created on the Site. "Digital Product" means any digital game key, activation code, gift card code, or software license sold on the Site. "Order" means a request submitted by you to purchase a Digital Product. "Platform" means the third-party service (e.g. Steam, Xbox, PlayStation Network, Nintendo eShop, Epic Games, Origin/EA, Ubisoft Connect, Battle.net) on which a Digital Product is redeemed. "Content" means all text, images, software, and other materials made available on the Site.

3. Eligibility & user accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an Account or make a purchase. By registering, you confirm that all information you provide is accurate, current, and complete, and you agree to keep it up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. Notify us immediately at support@bestswitchinggames.com if you suspect any unauthorized use.

4. Product purchases

All Orders placed on the Site constitute an offer to purchase a Digital Product, which we may accept or decline at our sole discretion. A binding contract is formed only when we send you an Order confirmation email containing your activation key or download link. Pricing, availability, and product descriptions may change at any time prior to acceptance of your Order. We reserve the right to cancel any Order at any time before delivery, including in cases of suspected fraud, pricing errors, stock exhaustion, or breach of these Terms.

5. Digital game key delivery

Digital Products are delivered electronically to the email address associated with your Account and made available in your Account dashboard under "My Orders". Typical delivery is instant; in rare cases where manual verification is required (for example, first-time purchases or high-value Orders), delivery may take up to 24 hours. We are not liable for delivery delays caused by incorrect email addresses, spam filters, or outages affecting third-party Platforms. By purchasing, you expressly consent to immediate performance of the contract and acknowledge that this means your statutory right of withdrawal is lost once the key is revealed to you (see our Refund Policy).

6. License and ownership disclaimer

When you purchase a Digital Product you receive an activation code that grants you a limited, personal, non-exclusive, non-transferable license to access the underlying game or software, subject to the end-user license agreement (EULA) and terms of service of the relevant Platform and publisher. We do not own, develop, or publish the games sold on the Site; we act as an authorized reseller of licenses procured from publishers and authorized distributors. All trademarks, logos, and intellectual property in the games remain the property of their respective owners.

7. Platform compatibility and regional restrictions

Every product page clearly displays the required Platform and region (e.g. Global, EU, US, UK, ROW). It is your responsibility to verify that your account, hardware, and geographic location are compatible with the Digital Product before purchase. Keys are issued for the specific Platform and region listed; activation on incompatible accounts may be blocked by the Platform and is not grounds for a refund.

8. Pricing and payment terms

All prices are displayed in your selected currency and, where applicable, include VAT or equivalent local sales tax at the rate in force at the time of purchase. We accept payment via major credit and debit cards, PayPal, Apple Pay, Google Pay, and selected local payment methods. Payment is processed by our PCI-DSS compliant payment partners; we do not store full card details on our servers. If a payment is reversed, charged back, or otherwise fails, we may immediately suspend access to the Digital Product and any associated Account.

9. User responsibilities & acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) submit false or fraudulent information; (c) use stolen, cloned, or unauthorized payment methods; (d) resell, redistribute, or commercially exploit Digital Products without our prior written consent; (e) attempt to circumvent regional restrictions, anti-fraud controls, or security features of the Site; (f) interfere with the operation of the Site or the experience of other users; or (g) scrape, copy, or republish Content from the Site without permission.

10. Fraud prevention

We employ industry-leading fraud prevention tools and may, before delivering a Digital Product, request additional verification (such as a copy of an ID document or proof of payment ownership). Orders flagged as high-risk may be held, refunded, or cancelled. We cooperate with law enforcement and payment networks to investigate fraudulent activity, and we reserve the right to share Order and Account information where required by law.

11. Account suspension and termination

We may suspend or terminate your Account, refuse to process Orders, or revoke previously issued Digital Products if you breach these Terms, engage in fraudulent activity, abuse our refund process, file an unjustified chargeback, or behave abusively toward our staff. Termination does not affect any rights or obligations that arose before termination.

12. Intellectual property

The Site, including its design, code, logos, trademarks, product descriptions, and editorial content, is owned by Best Switching Games Ltd. or licensed to us, and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written consent. Game artwork, trailers, and trademarks belong to their respective rights holders and are used under fair-use editorial or distributor agreements.

13. Disclaimers and limitation of liability

The Site and all Digital Products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, except those that cannot be excluded under applicable law. To the maximum extent permitted by law, Best Switching Games Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or in-game items. Our total aggregate liability for any claim arising out of or in connection with an Order shall not exceed the amount you paid for that Order.

14. Indemnity

You agree to indemnify and hold harmless Best Switching Games Ltd., its directors, employees, and partners from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

15. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, law, or industry best practice. The "Last updated" date at the top of this page indicates when the latest revision took effect. Material changes will be communicated via email or a notice on the Site at least 14 days before they take effect. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms and any dispute or claim arising out of them are governed by the laws of England and Wales, without regard to its conflict of laws provisions. You and Best Switching Games Ltd. agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any such dispute, except that nothing in this clause prevents a consumer from bringing proceedings in the courts of their country of residence where required by mandatory consumer protection law.
